Privacy Policy

We understand the importance of protecting the privacy of your personal information. In handling personal information, we comply with the Privacy Act 1988 (Cth) (Privacy Act), as amended from time to time, and with the 13 Australian Privacy Principles in the Privacy Act and other applicable privacy-related legislation.

We collect, use, disclose and store your personal information in accordance with our privacy policy, a copy of which can be found on Loopholes website or otherwise made available to you upon request.

We may collect your personal information directly from you or your authorised representatives, from third parties where you have provided your consent, or where the collection of your personal information is permitted by law.

The types of personal information we collect general identification information such as names, occupation, and date of birth, contact details such as address, email address, and mobile phone number, government-issued identification numbers such as tax file numbers, financial information, and information regarding your superannuation and/or insurance arrangements.

Generally, we collect, use and disclose your personal information for the purposes of providing you with taxation services. The tax returns require this information for its completeness. 

If you do not provide your personal information to us, this may affect our ability to assist you.

 

We may also use your personal information for the purpose of providing marketing- namely newsletters or important taxation updates/information that may be relevant to you. Please let us know if you do not want this information to be sent to you.

To provide taxation/accounting services, we may disclose your information to third parties engaged to perform administrative or other business management services only on request by you. Or for other financial/legal matters all requiring permission and consent by you in writing. 

Any disclosure is always on a confidential basis. We may also disclose your personal information if required or authorised by law.

Loopholes may disclose personal information to overseas recipients to provide necessary taxation services and for administrative or other business management purposes. Before disclosing any personal information to an overseas recipient, Loopholes take steps reasonable in the circumstance ensure the overseas recipient complies with the Australian Privacy Principles or is bound by a substantially similar privacy scheme unless you consent to the overseas disclosure or it is otherwise required or permitted by law. We would always request in writing written permission or consent to do so.

We will not use your TFN, pension number or any other government agency identifier as our internal identifier. We will only use and disclose these numbers for the purposes required by law or with consent from you, such as disclosing your TFN to the Australian Taxation Office or investment bodies.

 

We take appropriate steps to protect the personal information we hold about you from interference, misuse, loss, unauthorised access, modification, or disclosure

 

Internet privacy - With the help of our service partners, we may collect information from you when you use any of our online services (such as our website).

You may be able to access external websites by clicking on links we have provided. Those other websites are not subject to our privacy standards, policies and procedures. You will need to contact or review those websites directly to ascertain their privacy standards, policies and procedures comply.

 

Access to and correction of personal information - We aim to make sure that the personal information we collect, use or disclose is accurate, complete and up to date. If you believe your personal information is not relevant, accurate, complete or up to date, please contact us. We can update some client personal information over the telephone or via email but in certain instances we require signed instructions for security reasons. We may also take steps to update personal information by collecting personal information from publicly available sources.

Security measures are used to keep details of data stored, and to keep it safe. The steps taken to protect data from unauthorised access, loss or misuse include – 
   •    Encryption: Protecting sensitive data both in storage and during transmission over the internet.
   •    ATO access is via digital ID and multi-factor authentication.
   •    Access controls: Only authorized staff have access, often via strict passwords and multi-factor authentication.
   •    Storing physical files in locked cabinets and maintaining restricted-access facilities.
   •    Third-Party providers: Cloud storage is used. These are managed by IT services proactive IT support and cybersecurity solutions with 24/7 monitoring and security from threats.
   •    Property Surveillance 24/7.
When information is no longer needed, Loopholes is responsible for securely destroying documents using an independent shredding service that will shred documents on site. Security shredding bins are kept under secure lock. Information is also de-identified with the secure close of files within the CRM databases. 
 

Complaints:

If you have a complaint about the handling, use or disclosure of your personal information, we will investigate your complaint and advise you of the outcome as soon as possible in accordance with our Dispute Resolution Process.

 

If the matter is not resolved to your satisfaction, you may then refer your complaint to Australian Financial Complaints Authority (AFCA).
